1. Acceptance of Terms

By accessing or using PictureBook by BookAuthor.AI ("the Service") at picturebook.pub, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

PictureBook by BookAuthor.AI is an AI-powered platform that enables users to create illustrated picture books, including children's stories, coloring books, vision books, and other creative content. The Service uses artificial intelligence to generate stories and images based on user inputs.

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

4. AI-Generated Content

You acknowledge and agree that:

• AI makes mistakes. Content generated by AI, including stories and images, may contain errors, inaccuracies, inconsistencies, or unexpected results. This is an inherent characteristic of AI technology and is part of the creative experience.
• No guarantee of perfection. We do not guarantee that AI-generated content will be error-free, meet your exact expectations, or be suitable for any particular purpose. Results may vary in quality, accuracy, and relevance.
• Your responsibility to review. You are responsible for reviewing all AI-generated content before publishing, printing, or sharing it. You should not rely on AI-generated content without verification.
• Variability in output. The same prompt may produce different results at different times. AI generation is non-deterministic, and previously achieved results may not be reproducible.

5. Credits and Payments

Credit System

The Service operates on a credit-based system. Credits are consumed when generating AI content (stories and images). New accounts receive a limited number of trial credits. Additional credits can be purchased through the Service.

No Refunds on AI Generations

Credits spent on AI generations are non-refundable. Once credits are used to generate stories or images, they cannot be refunded or restored, regardless of the quality or outcome of the generated content. By using the Service, you accept that AI-generated results may not always meet your expectations and that this does not entitle you to a refund.

Credit Purchases

Credit purchases are processed through Stripe. Purchased credits do not expire and remain in your account until used. Refund requests for unused credit purchases may be considered on a case-by-case basis within 14 days of purchase by contacting our support team.

6. Print-on-Demand Orders

We offer print-on-demand services through a third-party printing partner. When ordering printed books:

• Print quality depends on the resolution and quality of AI-generated images
• Colors in printed books may differ from what appears on screen
• Shipping times and costs are determined by the printing partner and your location
• Print order issues (damaged items, shipping errors) should be reported to our support team, and we will work with the printing partner to resolve them

7. Intellectual Property

Your Content

You retain ownership of the original text and prompts you provide. For AI-generated content (stories and images), you are granted a broad license to use, modify, print, distribute, and commercialize the generated works for personal and commercial purposes.

Our Service

The Service itself, including its design, code, features, and branding, is owned by BookAuthor.AI and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service.

AI-Generated Content Limitations

AI-generated content may inadvertently resemble existing copyrighted works. You are responsible for ensuring that your use of generated content does not infringe on third-party rights. We make no warranties regarding the originality or copyright status of AI-generated content.

8. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, or hateful
• Create content that exploits or endangers minors
• Generate explicit sexual or excessively violent content
• Impersonate any person or entity
• Attempt to bypass safety filters or content moderation systems
• Use automated systems to access the Service without permission
• Interfere with or disrupt the Service or its infrastructure
• Violate any applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these rules without prior notice or refund.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR NEEDS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKAUTHOR.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES ARISING FROM AI-GENERATED CONTENT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless BookAuthor.AI and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) will survive.

13. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service will be resolved through good-faith negotiation. If a resolution cannot be reached, disputes will be submitted to binding arbitration.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date and, where appropriate, notifying you through the Service. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
